Use of the Mobylog.com website shall be at the sole and absolute discretion of Midas Events. Mobylog.com specifically reserves the right to remove any images, including those which it believes in its sole and absolute discretion are inappropriate, offensive, damaging, inflammatory, or otherwise objectionable. Mobylog.com reserves the right to cancel any person's registration and to remove any materials related to such member without notice or cause.

1. User Terms

1.1 The User acknowledges that the Site and databases in general may be error free and agrees that the existence of such errors shall not constitute a breach of this agreement.

1.2 Mobylog.com is the owner of the copyright and database right in the Software and the Databases and will do all things reasonably necessary to protect them against unauthorised copying or other infringement.

1.3 Although mobylog.com does not warrant that the Site shall be free from all known viruses, mobylog.com has used commercially reasonable efforts to check for the most commonly known viruses prior to launching the site. However, the User is solely responsible for virus scanning downloads.

1.4 The user alone is responsible for the consequences of any information, programs and other information that the User receives as a result of the use of the Sites, including without limitation, the entire responsibility of any losses of data, programs, breaches of security, viruses and disabling or harmful devices that the User may download or otherwise experience as a result of the User’s use of the Sites

1.5 The User agrees to use the Sites in a manner consistent with any and all applicable laws and regulations.

1.6 You may only use the Site for lawful purposes; in particular you may not use the Site:

(a) to post or transmit defamatory, offensive or abusive material or material of an obscene or menacing character; or

(b) in breach of copyright or other intellectual property right.

(e) images containing offensive or racist material, (d) images not owned by the uploader,

(f) images taken in dressing rooms, hospitals, medical facilities, homes or other private locations where the subject(s) of the image does not appear to know the image is being recorded,

(g) images containing copyrighted material not owned by the uploader, such as images taken of movies, concerts, works of art, etc.,

(h) images of driver's licenses, credit cards, or other personal financial information,

(i) images depicting, promoting and/or inciting violence,

(j) images depicting, promoting or providing instruction regarding illegal activities,

(k) images depicting, promoting or inciting cruelty to animals, and

(l) images infringing on another's right of publicity

1.7 The Site is to be used by a single user only. You may not sell on or sublet the Site. You agree to inform us of any change of address or telephone number supplied on registration.

1.8 The User agrees not to disclose your password to any other person. If it becomes known, you will inform the MOBYLOG.COM helpdesk immediately. The MOBYLOG.COM helpdesk may require you to change your password where it considers necessary.

1.9 The User acknowledges that you cannot exercise control over the content of material transmitted or received using the Site.

1.10 The User may not use the Site to transmit

(a) any material (including viruses) which is likely to cause harm to MOBYLOG.COM or any other computer systems;

(b) IP Multicast or other applications which make similar demands for bandwidth; or

(c) excessive material using the UDP protocol.

1.11 The Users may not use more than 20 Mb of capacity for blogging.

1.12 The User acknowledges that if, for any reason, you do not access your account for a period of one month or longer, Preferred Outsourced ISP and MOBYLOG.COM reserves the right to terminate your account, delete all information stored on it and delete your web space without notice to you.

1.13 The User should not retain information of value to you, which can only be accessed using the Site, or rely on the Site for transmitting information of value to you.

1.14 The User agrees to fully indemnify and to hold MOBYLOG.COM and Preferred Outsourced ISPs and Midas Events and all their employees indemnified from and against any claim brought by a third party resulting from the use of the Site and in respect of all losses, costs, actions, claims, expenses or liabilities whatsoever suffered or incurred directly by members or third parties in consequence of your breach or non-observance of these terms.

2. Site Availability

2.1 MOBYLOG.COM reserves the right at its discretion to refuse to:

(a) accept your registration; or

(b) provide access to the Site.

2.2 MOBYLOG.COM may restrict access to certain types of information brought to its attention, which may cause offence to other users of the Site.

3. Period

3.1 The User may stop using the site at any time. Mobylog may but is not obliged to delete material posted on site by the User. No claims for loss or damage direct or remote allegedly sustained on account of such deletion shall be entertained.

3.2 MOBYLOG.COM may terminate the Site immediately:

(a) if it has reason to believe that you are not using the Site in accordance with these terms; or

(b) if a competent regulatory authority requires mobylog.com or any of its suppliers to do so;

4. Warranty

4.1 MOBYLOG.COM shall provide the Site using reasonable care and skill.

4.2 MOBYLOG.COM endeavours to provide a Site, which is available at all, times, but it cannot warrant the availability due to factors beyond its control.

4.3 MOBYLOG.COM gives no warranty as to the quality of or accuracy of information received using the Site.

4.4 Users registering and /or otherwise using the site do so at their own risk.

5. Limitation of Liability

5.1MOBYLOG.COM accepts no liability in contract, tort or otherwise including negligence for:

(a) inability to gain access to the Site as a result of routine or emergency maintenance on the system or excessive demand for the Site;

(b) loss of data including both data transmitted and other data held by you;

(c) delay or failure in transmitting or receiving material;

(d) indirect or consequential losses arising from use of the Site including loss of revenue, business, anticipated savings or profits.

6. Miscellaneous

6.1 In order to register you must enter all of the requested information, including an accurate and viable e-mail address. All website registrants will receive e-mail confirming their registration with Mobylog.com. Mobylog.com also uses e-mails to inform registrants of new membership benefits and features, to advise registrants of urgent problems on its website and from time to time to present special opportunities at the Mobylog.com website.

6.2 Mobylog.com may use, sell and/or share with its affiliates any information provided by you on this website, including your name, e-mail address, usage patterns, and uploaded images and text.

6.3 Any attempt by any individual to damage, destroy, tamper with or vandalize this website is a violation of criminal and civil law and Mobylog.com will diligently pursue all remedies in this regard against any offending individual or entity to the fullest extent permissible by law.

6.4 Although Mobylog.com does not and cannot police all of the images and comments on this site, images and comments which Mobylog.com in its sole and absolute discretion believes may have been uploaded in violation of these Terms and Conditions shall be removed from the website.

6.5 Mobylog.com and any images and comments on this website are intended for personal use only and may not be used except by Mobylog.com for commercial purposes.

6.6 Mobylog.com may, in our sole discretion, and without your consent or payment to you, place third-party advertisements on any Web page within our site including your mobylog or on any software component that displays mobylog contents on any other website.

6.7 Mobylog.com expressly disclaims any warranty, express or implied, including the warranty of merchantability, warranty of fitness for a particular purpose, and the warranty of no infringement.

6.8 You agree that Mobylog.com and Midas Events shall have no liability for special, economic, non-economic, incidental, direct, indirect, or consequential damages of any kind in connection with your use of this website or service, whether or not such damages are foreseeable.

6.9 This agreement and your use of the Mobylog.com website shall be governed under laws of India and by logging on to the site and/ or registering as a User you hereby expressly agree to submit to the exclusive jurisdiction of Courts in Mumbai, India in relation to any disputes arising from or related in any way to your use of Mobylog.com and/or the images and/or content contained herein.

6.10 The Terms and Conditions set forth on this website are the complete, incorporated agreement between you, Moblog.com and Midas Events and may not be modified without the express written agreement of Midas Events.
